While we strive to meet the highest standards in reliability, performance, and functionality, all services are provided without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
The performance of custom software may depend on factors outside our control, such as third-party APIs, hosting infrastructure, or changes to external environments. Therefore, we do not guarantee error-free operation or uninterrupted access, and we shall not be liable for issues arising from improper use, misconfiguration, or third-party system failures.

To the fullest extent permitted under applicable law, TEJAS AI TECH shall not be held liable for any:
- Indirect, incidental, special, punitive, or consequential damages, including but not limited to:
- Business interruption
- Financial losses due to software or trading strategy use

- Downtime or availability issues
- Loss of client investments or trading capital
- Loss of anticipated profits or revenue
- TEJAS AI TECH assumes no responsibility for project delays caused by:
- Client's failure to provide required information or approvals
- Hosting limitations or client-side network issues
- Dependency on third-party providers
- Clients are solely responsible for:
- Monitoring service expiration and renewals
- Maintaining backups unless otherwise agreed
- Conducting thorough backtesting of trading strategies
- Applying necessary software updates

All software, data models, algorithms, code, digital assets, and intellectual property developed by TEJAS AI TECH during a project are considered:
- Company-owned intellectual property if they are:
- Reusable frameworks, scripts, or internal libraries used across clients
- Built without specific client-provided logic, datasets, or workflows
- Client-owned deliverables if:
- The solution is custom-built exclusively for the client
- It is explicitly agreed upon in the contract (i.e., full source code ownership transfer)
Unless otherwise agreed:
- The software is licensed, not sold, for the client's use
- Clients may not resell, sublicense, or redistribute the software without written permission
- Clients retain ownership of any proprietary data, logic, or materials they provide
📄 General
- Server and Hosting Requirements: In the event of increased website traffic or application usage demands, clients may need to upgrade their server or hosting plan to ensure optimal performance and accommodate the additional load.
- Modification of Service Plans: We reserve the right to modify, amend, or update our service plans or pricing structure at our discretion.
- Service Expiration and Continuity: Clients are responsible for monitoring their service expiration dates, as services will be paused / servers will be deleted beyond the specified expiration date until renewal is completed. Service continuity will resume upon receipt of payment or confirmation of renewal, per the terms of the original service agreement.
- Project Cancellation Policy: Should the client decide to terminate the project, any advance payments made are non-refundable. This policy applies regardless of the project stage at the time of cancellation, as initial deposits cover preliminary work, resource allocation, and project setup costs.
- Additional Functionality and Features: Any requests for functionalities or features beyond the initially agreed-upon scope will incur additional charges. These charges will be determined based on the scope and complexity of the requested modifications. Our team will provide a detailed quote before commencing any additional work.
- Non-Refundable Fees for Third-party services: We offer resale services for specific products and services. Payments for server/hosting plans, market data access, and similar third-party service fees are non-refundable under any circumstances, as these services are sourced from external providers who impose strict no-refund policies.
- Service Availability and Downtime: While we strive to provide continuous access to our services, periodic maintenance or unforeseen technical issues may result in temporary downtime. Our team will endeavour to minimise any service interruptions and notify clients of any scheduled maintenance in advance.
- Software and AI Model Performance: The performance and accuracy of any AI models, algorithms, or software solutions provided depend on various factors, including data quality and usage conditions. TEJAS AI TECH does not guarantee specific outcomes and shall not be held responsible for any discrepancies or inaccuracies arising from model or software use.
- Service and Software Updates: Periodic updates may be released to enhance functionality or security. Clients are responsible for implementing these updates to maintain service quality. Additional fees may apply for updates that involve substantial system changes or client-specific modifications.
- Dispute Resolution: Any disputes arising from these terms shall be resolved through binding arbitration, in accordance with the governing laws of Jalgaon, Maharashtra, India.
- Stock Market Product Testing, Client Responsibility, and Back testing Requirements: During the testing phase of stock market-related products, clients must provide their trading account with the necessary funds as determined by the product or strategy requirements. Any funds utilised during this phase will belong exclusively to the client, and any profits or losses incurred during the testing period will be the sole responsibility of the client.
For products or strategies developed based on the client's specific logic or requirements, the client will bear full responsibility for the outcomes, as the strategy belongs to them, and they are better positioned to understand the expected results than TEJAS AI TECH. Clients are also required to thoroughly back test the strategy in simulated conditions before implementing it with actual funds to minimise risk and ensure confidence in its performance.
TEJAS AI TECH will not be held liable for any financial outcomes during the testing or implementation phases, as this process is conducted solely for evaluation purposes and to validate the product's performance under real-world conditions.
